Terms and Conditions of Use for Catherine Gason’s Services and Digital Content

ACCEPTANCE OF TERMS OF SERVICE

If you do not accept the terms and conditions of CATHERINE GASON’s services or websites, you must discontinue using them.

The COMPANY may revise this agreement at any time by updating the TERMS OF SERVICES. Accessing and using CATHERINE GASON’s websites after such changes are posted will indicate your agreement to these revised terms. You should visit this page periodically to review this agreement.

USE OF SERVICES, LIMITATIONS OF LIABILITY

The COMPANY cannot guarantee that the SERVICES will work 24 hours a day, 7 days a week. The COMPANY also reserves the right to suspend or limit access if necessary. In any case, the COMPANY will not be liable if for any reason all or any part of the SERVICES is not available at any time or for any period, nor for any loss of data.

The information, texts and other data published in the GasOn Marketing workshop and courses as well as any links to other websites are for information purposes only. The COMPANY does not guarantee the regular updating of the information contained in its SERVICES nor its exhaustiveness and cannot therefore be held responsible for any damage, including consequential and indirect damage, deriving from, or in any way connected to the use of the information connected to its workshop, courses or websites.

Furthermore, CATHERINE GASON cannot be held responsible for any damage such as, by way of an example, infections caused by computer viruses that the computers of users or visitors may suffer due to the access and/or to the interconnection with the COMPANY’s websites or by downloading their content or for any damage, of whatever nature, caused directly or indirectly by the inability or impossibility to access its SERVICES.

On the other hand, the links present in CATHERINE GASON’s workshop, courses and websites can direct users’ and visitors’ research towards web pages found on other websites that are not subject to the control of CATHERINE GASON. The COMPANY assumes no responsibility for the content of what is published in these websites, for the use that third parties may make of it and for any damage caused by or originated during the access to such websites, by the interconnection to the same or by the downloading of their content.

INTELLECTUAL PROPERTY RIGHTS

The information, logos, images and trademarks are the property of their respective owners.

The reproduction of content of the workshop, courses or on CATHERINE GASON’s websites is not permitted. It is therefore forbidden to alter, copy, reproduce, distribute, transmit or diffuse without authorisation the content of the COMPANY’s workshop, courses and websites to other websites or any other supports. It is also forbidden to copy the applications that characterise the operations of the SERVICES, the workshop, the courses and the website gason-marketing.com.

Any non-personal information communicated to CATHERINE GASON through its workshop, courses and websites (including suggestions, ideas, images, projects, etc.), will attribute to CATHERINE GASON the right to use, reproduce and show what was transmitted. The communication/transmission of such information will automatically entail the transfer of the same, free of charge, with the widest possible right and faculty, to CATHERINE GASON.

DISCLAIMER

The COMPANY is not responsible for any direct or consequential damages resulting from the use of the SERVICES and the user agrees to defend and indemnify CATHERINE GASON from any claims, losses, expenses (including but not limited to legal fees) arising from the violation of the rights of third parties attributable to him.

The user uses the SERVICES, the workshop, the courses and the websites, at his own risk. The COMPANY is not liable to any party for legal/civil or administrative disputes, indirect, specific, incidental, punitive, cautionary or consequential damages caused by the use or inability to use the SERVICES. The COMPANY cannot guarantee to the user secure revenues deriving from the exploitation of the SERVICES, the workshop, the courses and the websites.

CANCELLATION

In the case of paid SERVICES, the purchaser has the right of withdrawal within 14 days of receiving the purchased service. The purchaser should inform CATHERINE GASON by sending an email to info@gason-marketing.com indicating the purchaser’s name and including a copy of the purchase invoice. The refund will be made within 14 days of receiving the returned items related to the paid SERVICES.

SERVICES AND DIGITAL CONTENT EXCLUDED FROM THE RIGHT OF CANCELLATION

SERVICES that the COMPANY has fully performed if the USER accepted when placing the order that the COMPANY could start to perform the SERVICES and that it could not be cancelled once delivery had started.

DIGITAL CONTENT which is not supplied on a tangible medium if the USER accepted when placing the order that the COMPANY could start to deliver the DIGITAL CONTENT and it could not be cancelled once delivery had started.

ONLINE DISPUTE RESOLUTION (ODR)

Catherine Gason is committed to resolving disputes in a fair and efficient manner. If you have a dispute or claim related to your use of Catherine Gason’s websites or services, please consider utilising the European Commission’s ODR platform for assistance. You can access the platform at http://ec.europa.eu/consumers/odr/ for more information.

The data will be processed in accordance with the relative Privacy Policy.
Any information sent to CATHERINE GASON will be treated in accordance with the General Data Protection Regulation EU 2016/679.

GOVERNING LAW AND JURISDICTION

These TERMS OF SERVICE and all matters arising from it shall be governed by and construed in accordance with the Italian laws and shall be subject to the exclusive jurisdiction of the Trieste (Italy) Courts.

Il sito web gason-marketing.com, la formazione, lo workshop e i corsi GasOn Marketing, sono di proprietà della ditta Catherine Gason (di seguito anche indicata come la DITTA o CATHERINE GASON). I seguenti termini e condizioni (insieme definiti come i TERMINI DEL SERVIZIO) si riferiscono all’utilizzo di tutti i servizi, contenuti digitali, formazione, workshop, corsi e siti web della DITTA (di seguito anche indicati collettivamente come i SERVIZI) e includono ogni contenuto o funzionalità o servizio in essi contenuti.

Le funzionalità e caratteristiche all’utilizzo dei SERVIZI potrebbero essere aggiornate nel futuro e la DITTA si riserva il diritto di aggiornare periodicamente i SERVIZI e di conseguenza questi TERMINI DEL SERVIZIO, a sua completa discrezione. L’utilizzo continuato dei SERVIZI significherà accettarne per intero le modifiche. UTILIZZAZIONI E LIMITAZIONI DI RESPONSABILITÀ

La DITTA non può garantire che i SERVIZI funzioneranno 24 ore su 24 e 7 giorni su 7. CATHERINE GASON si riserva anche il diritto di sospendere o limitare l’accesso ad alcune funzioni qualora fosse necessario nell’ottica di migliorare quanto offerto. In ogni caso, la DITTA non sarà responsabile se per qualsiasi motivo tutta o qualsiasi parte dei SERVIZI non sia disponibile in qualsiasi momento o per qualsiasi periodo, né per qualsiasi perdita di dati.

La DITTA non si ritiene responsabile di danni eventuali diretti o consequenziali derivanti dall’utilizzo dei suoi SERVIZI, workshop, corsi o siti web, e l’UTENTE accetta di difendere e indennizzare CATHERINE GASON da eventuali reclami, perdite, spese (incluse ma non limitate alle spese legali) derivanti dalla violazione dei diritti di terze parti a lui imputabili.

L’UTENTE utilizza i SERVIZI a proprio rischio. La DITTA non è responsabile nei confronti di alcuna parte per controversie legali/civili o amministrative, o per danni indiretti, specifici, incidentali, punitivi, cauzionali o consequenziali (a titolo esemplificativo ma non esclusivo: danni in caso d’impossibilità di utilizzo o accesso ai SERVIZI, perdita o corruzione di dati, di profitti, di clientela, danni d’immagine, interruzioni dell’attività o simili), causati dall’utilizzo o dall’impossibilità di utilizzare i SERVIZI, workshop, corsi o siti web, e basati su qualsiasi ipotesi di responsabilità inclusa la violazione di contratto, la negligenza, o altro. La DITTA non può garantire all’UTENTE introiti sicuri derivanti dallo sfruttamento dei suoi SERVIZI, workshop, corsi o sito web gason-marketing.com.

DIRITTO DI RECESSO

In caso di SERVIZI a pagamento, è riconosciuto all’acquirente il diritto di recedere entro 14 giorni a partire dalla ricezione del servizio comprato. L’acquirente potrà informare CATHERINE GASON della propria decisione di esercitare il diritto di recesso, inviando all’indirizzo info@gason-marketing.com un messaggio email indicante il proprio nome e includente copia della fattura d’acquisto. Il rimborso sarà effettuato entro 14 giorni dalla ricezione della restituzione degli articoli legati al servizio comprato.

SERVIZI E CONTENUTI DIGITALI ESCLUSI DAL DIRITTO DI RECESSO

Il diritto di recesso non può essere esercitato in relazione a:
SERVIZI per i quali l’UTENTE ha accetto al momento dell’ordine di perdere il diritto di recesso dopo la completa prestazione, e di cui l’UTENTE ha accettato l’inizio della prestazione.
CONTENUTI DIGITALI forniti mediante un supporto non materiale una volta iniziato il download.

Effettuando un ordine per l’acquisto di tali SERVIZI e/o CONTENUTI DIGITALI, l’UTENTE accetta quanto precede.

PIATTAFORMA PER LA RISOLUZIONE ONLINE DELLE CONTROVERSIE (ODR)

Catherine Gason si impegna a risolvere le controversie in modo equo ed efficiente. Per eventuali controversie o reclami relativi all’uso dei siti web o dei servizi di Catherine Gason, si consiglia di utilizzare la piattaforma ODR della Commissione Europea per ricevere assistenza. I dati verranno trattati in accordo con la relativa Privacy Policy.
